Who this agreement is between

AXYMEDIA LLC (“Axymedia”, “we”) and the business that creates an AXY OS account (“you”). AXY OS is sold to businesses; by creating an account you confirm you act for one. Questions: [email protected].

What the service is

AXY OS is a modular operating system for local businesses: an AI assistant that answers on your WhatsApp number and your website chat, a managed website, and finance tools — each module available as marked on our site, and only as marked. What is marked as not yet available is not part of this agreement until it is.

Three product truths are part of the deal, because they protect you:

• The assistant does not confirm a booking unless you set it to. Every booking is a request you approve, on every service, until you choose otherwise — the choice is per service, in Services. What lands on your calendar is what you set it to do.
• The assistant replies; it does not cold-message. Outbound messages are replies to your customers or messages you choose to send, within the messaging platform’s rules.
• AI answers can be imperfect. The assistant is grounded in the knowledge you give it and escalates to you when unsure, but you review what matters and you remain responsible for the decisions you approve.

Your account and your data

Keep your credentials safe and your account information accurate. Your business data and your customers’ data remain yours: you grant us only the licence needed to run the service for you — host your site, carry your conversations, write your calendar. For personal data, you are the controller and we process on your behalf, as described in the privacy policy, which is part of this agreement.

What you agree not to do

Use the service only lawfully and only for your own business: no spam, no harassment, no content that is illegal where you or your customers are, no attempts to break or probe the platform, and no use that violates WhatsApp’s or Meta’s business policies — losing your number to a platform ban helps nobody. You confirm you are entitled to share with us the data you connect to the service.

Price and term

Prices, currencies and any minimum term are shown on the pricing page and at checkout, before you pay — what you see there is what applies. Where a plan carries a minimum term, it is stated before purchase; after any minimum term, plans continue month to month until ended. Prices exclude taxes required by law. If payment fails and stays failed after we tell you, we may suspend the service until it is settled.

Ending the agreement

You can end it from your account or by writing to us, effective at the end of the paid period, honouring any stated minimum term. We can end it with reasonable notice, or immediately if the service is used unlawfully or in breach of these terms. After the end we return or delete the data we processed for you, as the privacy policy describes.

Availability and changes

We run the service with care, show its uptime on your dashboard rather than asking you to take our word for it, and fix what breaks — but no online service can promise uninterrupted availability and we do not. We improve the product continuously; if a change materially reduces what you pay for, we tell you before it applies.

What we are liable for

To the extent the law allows: we are liable for damage we cause deliberately or by gross negligence, and for anything the law does not allow us to limit. For the rest, our liability is capped at the fees you paid us in the twelve months before the event. We are not liable for the content of your business’s own communications or for decisions you approve.

Law and disputes

These terms are governed by the law of the country where Axymedia is established, and its courts have jurisdiction — without prejudice to any mandatory consumer or local rights the law gives you where you are.

Changes to these terms

When these terms change materially, we notify the account email before the change applies. Continuing to use the service after that date means the new terms apply.
